Digital Wallet Terms & Conditions
The storage and usage of your Final card in digital wallets are subject to these Terms, and the cardholder agreement that governs your account. Digital wallets - including Apple Pay, Samsung Pay and Android Pay, allow users to make purchases wherever the wallet is accepted, which may not include all locations your card is otherwise accepted.
When you add a Final card to a digital wallet, you agree:
In the event of any conflict between these Terms and your cardholder agreement, the terms and conditions of your cardholder agreement will control. You understand that your use of a wallet will also be subject to agreements or terms of use (which may include service fees in connection with device or wallet usage) with the relevant wallet provider or other third parties such as wireless companies or data service providers. The terms and account agreement that govern your Final card do not change when you add your card to the wallet. The wallet simply provides another way for you to make purchases with the card. Any applicable interest, fees, and charges that apply to your card will also apply when you use the wallet to access your card.
If you want to add a card to the wallet, you must follow the procedures adopted by the wallet provider and any further procedures we adopt. We do not charge you any fees for adding a card to the wallet.
You understand that not all cards are eligible to be added to the wallet. We may choose to not add a card to the wallet if we cannot authenticate it, if the account is not in good standing or if we otherwise suspect that there may be fraud associated with the card. We can also suspend your ability to use a card to make purchases using the wallet. We may take these actions at any time and for any reason, such as if we suspect fraud with your card, if you have an overdue or negative balance on your card account, if applicable laws change or if directed to do so by the wallet provider or the applicable card network. You may remove a card from the wallet by following the wallet provider’s procedures for removal.
Final and First Bank & Trust are not the provider of the wallet and are not responsible for its use and function, including the inability to use a wallet for a transaction (for which we will not be responsible for any loss, injury or inconvenience). We are only responsible for securely supplying information about your card to the wallet for transactions. You should contact the wallet provider’s customer support team if you have questions or issues regarding the wallet.
You agree to protect and keep confidential your User ID, passwords, and all other information required for you to make purchases with your card using the wallet. If you share these credentials with others, they may be able to access your wallet and make purchases with your card or obtain your personal information. Your cardholder agreement requires you to contact us promptly if you believe there are errors or if you suspect fraud with your card. We will resolve any potential error or fraudulent purchase in accordance with the cardholder agreement. We will not be liable for any losses you incur except as specifically described in the cardholder agreement or as otherwise provided by law.
In addition to your efforts to keep your credentials secure, we take reasonable steps to help ensure that information we send to others from your use of the wallet is sent in a secure manner. However, the wallet provider is ultimately responsible for the security of information provided to it or stored within it. We are not responsible if there is a security breach affecting any information stored in the wallet or sent from the wallet. We are committed to respecting the privacy of your information and we will not share your information in a manner that is inconsistent with our Privacy Notice. We will treat all personally identifiable financial information we obtain as a result of your use of the wallet consistent with the terms of the Privacy Notice. You agree that we may share your information with the wallet provider, the payment network, and others in order to provide the services you have requested, to make information available to you about your card transactions, and to improve our ability to offer these services.
As in your cardholder agreement, you agree to continue receiving electronic communications from us, including emails to the email address you have provided in connection with your account. You agree to update your email address when it changes by contacting at support@getfinal.com. You may also contact us if you wish to withdraw your consent to receive these electronic communications, but doing so may result in your inability to continue to use your card in the wallet and/or card account itself. These Terms are governed by federal law and, to the extent that state law applies, the laws of the state that apply to the agreement under which your card is covered. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures in your cardholder agreement.
We may change these Terms at any time by changing these Terms or your cardholder agreement, and we will provide advance notice of these changes if we are required to do so under applicable laws. You agree to any such changes by continuing to keep a card in the wallet. You can not change the Terms and if you do not accept a change to these Terms, you must remove all cards from all wallets. You may not assign these Terms. If you have any questions, disputes, or complaints about the wallet, you should contact the wallet provider.
